There is a deeply disturbing trend unfolding in the Indian judiciary.

The Raja Harishchandra within retired judges suddenly awakens the moment they leave office. They begin spilling the beans, making revelations and speaking out…sometimes even on the eve of hearings in important cases and at other times when matters are still sub judice.

Serving and retired judges appear to be competing with one another, each seemingly eager to expose the other…leaving their fellow judges dwarfed in the process.

Perhaps this is the greatest achievement of the powers that be…creating a deep and bitter rift between serving and retired judges, so much so that they no longer speak in unison to defend the dignity, independence and institutional integrity of the judiciary.

While in office, their silence is deafening. The moment they step out of the chair, their conscience finds its voice and they turn into activists.

They no longer speak through their judgments, as a judge is institutionally expected to do. While in office..they speak through oral observations that often find no place in the final judgment and are worth little in the absence of a reasoned judicial order.

The moment they retire, they turn into motor mouths, speaking freely on matters they remained conspicuously silent about while in office.

God save the Indian judiciary!
