9/ The lesson is not that governments will never face genuine emergencies. It's that extraordinary powers must remain subject to meaningful legal limits — particularly when governments believe those powers are urgently needed.

10/ This is one of the most important civil liberties cases in a generation. Two courts have affirmed the limits Parliament built into the Act. The Supreme Court will now have the final word. Support the case: theccf.ca/donate

If the government gets away with using the Emergencies Act in 2022, I shudder to think how they might abuse it in the future.

If you share this concern, please consider making a tax-deductible donation to the CCF so we can win again at the Supreme Court. theccf.ca/donate/

It's true some Freedom Convoy protesters broke the law and were held accountable. The protest in Ottawa caused a lot of headaches for residents.

But that was no reason to freeze protesters' bank accounts and ban even peaceful protesters who just wished to raise a Canadian flag.

The Federal Court and Federal Court of Appeal found that Trudeau did not meet these requirements, including showing there was a national (as opposed to local) emergency, and he had no evidence that there were "threats to the security of Canada" including the terrorism alleged.

The EA was passed in 1988 with strict thresholds that government must meet before it can be used.

This was purposeful: Canadians were horrified by abuses of civil liberties after the War Measures Act to intern Japanese Canadians and to round up dissidents in the October Crisis.
