Good morning on Day 4 of jury selection in the USS Cole bombing case — the first capital trial at the post 9/11 court at Guantánamo Bay. The court has selected two jury members, both Air Force officers. Three others have been excused.

Here’s a rundown on the story so far at @just_security.

The goal is now 20 members: 12 jurors, six alternates and two spares for excusal without cause. #Peremptory

Lawyers are now questioning an Army major, a former cavalry squadron commander. This officer was among the pool members who felt that, since the defendant had been held for 20 years at Guantánamo, he must be guilty of something.

He told a prosecutor that he looked up the defendant’s name when he was first put on notice to the case. “Before I was gagged,” he said.

Court is in recess until tomorrow. Jury selection is going very slowly. (Or, in military speak, deliberately.)
--One of the 18 officers in the on-island pool has been accepted to the jury
--The judge is mulling another
--Three have been released.
--The remaining 13 others have yet to be questioned.

--The judge also said he postponed the arrival of the next 18 pool members until after next week, because of Veteran's Day.

Math: That leaves 17 candidates for the panel for voir dire this week and next.

--Plus, today we learned the goal is to end up with 20 because each side can excuse one without cause.

Meantime, the two sides settled on member No. 1 (Air Force colonel, pilot) after the defense lawyer Allison Miller questioned him at length on his views on the death penalty.

Group voir dire has been completed on the first 18 military officer-candidates for the USS Cole jury. After lunch recess the court switches to individual questioning -- starting with an Air Force fighter pilot who is the most senior member of the group.

Sorry for delay: Court's in recess until 0900 tomorrow.
The judge and prosecution were able to pose their group questions to the first 18 candidates for the Cole jury before recessing for the night. The defense poses their group questions tomorrow before one-on-one questioning.

The goal: 12 jurors and 6 alternates from a pool of about 200 US military officers. This could take some time. Today, 10 of the first 18 said the length of time need for the trial at Guantanamo would be difficult.
One said his was morally or religiously opposed to the death penalty.
