Byli prezesi Trybunału Konstytucyjnego przerwali milczenie. Marek Safjan, Jerzy Stępień, Bohdan Zdziennicki i Andrzej Zoll wydali wspólne oświadczenie, w którym stają murem za nowo wybranymi sędziami TK.
Zdaniem sygnatariuszy należy zwołać Zgromadzenie Ogólne sędziów TK i podjąć uchwały w sprawie wniosków Prokuratora Generalnego o uchylenie immunitetów Bogdana Święczkowskiego i Bartłomieja Sochańskiego.

A laughable proposal, supported by Trump, for gas exports from Russia via Ukraine into the EU.
I don’t believe either Ukraine or the EU could accept this. And I suspect the U.S. Congress wouldn’t either (following the midterm elections on Nov 3rd).

France is showing the world what real accountability looks like. Paris prosecutors have launched a major criminal investigation into Elon Musk’s X, raided its Paris offices and summoned Musk and former CEO Linda Yaccarino for questioning.
The allegations are staggering, through algorithms, child sexual abuse material, sexually explicit deepfakes generated by Grok without consent, Holocaust denial, unlawful data extraction and election interference.
While Musk parades around pretending to be a defender of free speech, his platform faces allegations involving the exploitation of children, the sexual abuse of women through AI-generated imagery, the manipulation of political discourse and threats to democratic elections.
Bravo, France! This is what standing up to billionaire arrogance looks like. Democracy is not a billionaire's personal playground, social media platforms are not above the law, and Elon Musk does not get to buy himself immunity from accountability. France is making it clear that the rule of law still matters, and the rest of the democratic world should be paying attention.

Yesterday’s events at the Constitutional Tribunal were the culmination of the over 10-years longing conflict over this institution.
This conflict began in December 2015, when former President Duda, in violation of the Constitution, took the oath from 3 incorrectly elected judges (who were chosen for previously occupied positions). The crisis in the Constitutional Tribunal was subsequently deepened by the fact that incorrectly elected judges participated in the election of the two subsequent presidents of the Constitutional Tribunal, namely Julia Przyłębska and Bogdan Święczkowski.
According to the case law of the European Court of Human Rights (Xero Flor w Polsce sp. z o.o. v. Poland, no. 4907/18, 7 May 2021; M.L. v. Poland, no 40119/21, 14 December 2023) and the CJEU (Grand Chamber, judgment of 18 December 2025, Commission v Poland, C-448/23), a Constitutional Tribunal containing a defectively elected judge does not constitute an independent and impartial court within the meaning of Article 6 of the ECHR, and it is also contrary to EU law.
Subsequently, in the years 2016-2026, the Polish Constitutional Tribunal ceased to be an effective guardian of the Constitution; instead of protecting civil rights and freedoms, it became a tool for the destruction of the rule of law in the hands of the "Law and Justice" party. During this period, the Tribunal frequently ruled ultra vires, prioritized examining cases initiated by MPs from this party, and abandoned the examination of citizens' constitutional complaints. Furthermore, individuals acting as presidents of the Constitutional Tribunal repeatedly manipulated adjudicating panels contrary to regulations in order to guarantee a favorable ruling for "Law and Justice".
Such a politically subordinated Tribunal issued, among others, the judgment of October 22, 2020 (no. K 1/20), in which it excluded the possibility of abortion in the event of a severe and irreversible fetal defect, which sparked the largest wave of social protests in years.
Next, between March and September 2026, the Sejm of the current term elected 8 new judges to the Constitutional Tribunal. Because President Karol Nawrocki failed to fulfill the statutory obligation to administer the oath from 5 newly elected judges, these judges took their oaths in the presence of the Marshal of the Sejm on April 9 and October 14, 2026, and delivered them to the President.
On May 5, 2026, the ECtHR issued an interim measure (Dziurda and others v. Poland, no. 17392/26) ordering the Polish authorities to refrain from actions hindering the newly elected judges from taking up and performing their duties in the Constitutional Tribunal.
On October 13, 2026, the Venice Commission published an opinion in which it firmly concluded that the Polish president had no right to refuse to administer the oath from judges elected by the parliament, and in a situation when the President unlawfully refuses or delays to administer the oath, this oath may be taken without the physical presence of the President.
Despite the aforementioned ECtHR interim measure and the opinion of the Venice Commission, the acting President of the Constitutional Tribunal, Bogdan Święczkowski, and his deputy, Bartłomiej Sochański, refused to allow the five properly elected judges to adjudicate. This resulted in negative consequences for the possibility of the Tribunal's continued operation, in the form of:
- The inability to convene the General Assembly of the Judges of the Constitutional Tribunal to adopt the Tribunal's expenditure plan, and thus ensure the financing of its activities for the next year.
- The inability of the Tribunal to resolve cases in a full bench, as well as irregularities in the designation of all adjudicating panels, due to the omission of the properly elected judges in the allocation of cases.

Four former Presidents of the Constitutional Tribunal, from the "golden era" of this institution (including former judge of CJEU and former Polish ombudsman), supported the actions of Anna Korwin-Piotrowska and the rest of the new CT judges.
Passivity in the face of such by Judge Święczkowski and President Nawrocki, would not be compliant with the Constitution. There was a legal and moral obligation for the new judges and state authorities to act.

🇵🇱 Poland's police chief responds to his own officers: "Everything was legal"
After the "Policyjna Solidarność" union warned of collapsing morale and legal doubts over the operation at the Constitutional Court, Police Commander-in-Chief Gen. Marek Boroń has sent a letter to all by quoting the police oath, "to faithfully serve the Nation," the same oath opposition MPs had been reminding officers of all weekend.
His main points:
➡️The police presence at the court on Friday and Saturday was "necessary" to protect people inside and the crowds outside.
➡️All police actions were "fully in line with the law." "Our role is not to assess the functioning of the Tribunal."
➡️"I have never allowed, and will not allow, any of you to be exposed to unlawful liability" for doing their job.
On the leaked order putting riot units on full readiness from November 2 to 8, he says it had "nothing to do" with the court. Its real purpose: preparing for "attempts at destabilization in our country carried out by services from the East." The fact that it was sent the day before the court takeover, he says, "gives no one the right to create a false narrative."
He also says he is "outraged" that this "narrative" is being spread by some of his own officers, and warns that "breaking the unity of the formation" doesn't help Poland's security.
So: the government blames Russian bots, Sikorski blames Russian propaganda, and now the police chief blames "services from the East."

🇵🇱 Polish police union breaks ranks: "No officer wants to become part of political games"
The "Policyjna Solidarność" police union has sent an open letter to Police Commander-in-Chief Gen. Marek Boroń, demanding he publicly explain the police's role at the Constitutional Court.
s sent to Warsaw are mostly young recruits fresh out of basic training, with no experience of situations like this.
🔸️Officers from across the country have raised legal doubts about the operation, including possible interference with a constitutional body of the state. The union cites the Criminal Code articles on coups, attacks on constitutional bodies and abuse of power.
🔸️It points to MPs being refused entry and the President of Poland being "forced to squeeze through a police cordon," left without proper protection.
🔸️It says the leaked police readiness order "clearly indicates" the situation may have been planned in advance with police leadership.
And the line that will worry Tusk most:
"Since early morning, we have been receiving inquiries from families of police officers worried about the health and lives of their husbands, wives, sons and daughters, officers who know they have been left alone with accusations of committing crimes while carrying out their superiors' orders."
The union warns that morale has collapsed and that this could lead to protests like those of 2018 and 2021, when thousands of Polish police officers called in sick.
