The Qur’an also permits marriage before puberty and all early scholars agree on this. Only modern Muslims who refuse to admit the immorality of Muhammad say otherwise, because they dare not say a bad word about him, even though he raped a child.
Surah At-Talaq (65:4) establishes a divorce waiting period: “their waiting period is three months, and those who have not menstruated as well.”
Ibn Kathir, al-Qurtubi, and later Maududi understood this to include girls too young to menstruate… AKA: children.
This extends beyond a marriage contract. Qur’an 33:49 exempts marriages ended before consummation from a divorce waiting period. Maududi explicitly used this distinction to argue that 65:4 permits both marriage and consummation before menstruation… ie: marrying and having sex with children is okay.
