⚖️ C11 Work Permit Refusal Upheld Over Lack of Business Transition Plan- Shirouzhan v. Canada, 2026 FC 1280

An entrepreneur applied for an LMIA-exempt C11 work permit to establish a coffee roasting business in Vancouver.

IRCC refused the application, questioning whether the provide significant benefits to Canada and whether the applicant would leave at the end of his authorized stay.

The Federal Court upheld the refusal, finding that although the applicant had business experience and ties to Iran, his business plan did not adequately explain how management of the Canadian business would transition to others after his departure.

The Court also found that IRCC was not required to provide an opportunity to correct deficiencies arising from program requirements.

Judicial review dismissed.

C11 applicants must demonstrate not only the proposed business’s benefits but also a credible plan for their temporary stay, particularly when establishing a business intended to operate permanently.

Lots of increases for cancellations under the Rural Renewal stream. Looks like the Alberta PNP is changing requirements mid-stream. Such refusals, of course, do not go to the Federal Court but may be challenged by way of a special chambers application at the Court of King's Bench.

Express Entry: Think Your Employer Can Just Offer You a High-Wage Job for CRS Points? Think Again.

Under the new Express Entry changes taking effect November 3, 2026, an LMIA will no longer be required for qualifying job offers to receive CRS points.

But IRCC has made it clear ob offer must be genuine.

Officers will assess whether the employer is actively operating, genuinely needs the position and can reasonably afford to fulfil the job offer.

They will also examine whether the applicant has the qualifications, skills and experience to actually perform the job and is likely to take up the employment.

Simply getting an employer to offer you a managerial or other high-wage position does not automatically qualify you for 50, 70 or 100 CRS points.

Hopefully, IRCC applies these requirements consistently and effectively detects manufactured job offers created solely to obtain PR points.

An LMIA may no longer be required, but a genuine job offer still is.

I believe that a candidate can either get points for core Canadian work experience + additional points for Canadian work experience in a high wage occupation OR points for having a job offer. I don't think a candidate can get points for a job offer + Canadian core work experience

Max for high wage + CAD work experience with no spouse is 150 points. Max for job offer is 100 points and no points for core CAD work experience
