On Oct. 21, FAIR filed an amicus brief with the U.S. Court of Appeals for the Fourth Circuit on behalf of the former Virginia Attorney General Ken Cuccinelli.
The brief supported the Trump Administration’s lawsuit to block Virginia’s law nullifying 287(g) agreements between local law enforcement agencies and ICE.

We are, once again, suing the @nysdmv over its refusal to disclose basic CDL records.
FAIR had filed a FOIL request back in October 2025 seeking straightforward information about how the DMV was managing its CDL program, and whether it was doing it according to federal standards set by @FMCSA.
After requesting (and ACCEPTING!) a $2,000 process fee, the DMV turned around and issued a blanket denial of our whole request. Their argument? That we, a private non-profit, cannot receive these documents because we are 'ideologically aligned' with federal immigration enforcement agencies and are therefore functionally an arm of @ICEgov. The DMV also claimed that routine administrative licensing stats and internal policies are exempt as law-enforcement records, but pointed to no investigations that would be impacted by disclosure.

FAIR has filed a brief in the U.S. Court of Appeals for the Fifth Circuit defending a law in Texas called S.B.4, which protects Texas’s border with Mexico. A class of aliens has sued to strike down the law, claiming it conflicts with federal immigration law.
Here, in its brief supporting S.B.4, FAIR shows that the law is indeed permissible under the Constitution as a war measure by the state of Texas.
During the Biden Administration, Mexican cartels, which control the Mexican side of the border, ran massive numbers of foreign nationals from around the world, along with massive quantities of drugs and other contraband, into Texas and other states.
In response to this invasion by the cartels, Governor Greg Abbott declared war under Section 10 of Article I of the U.S. Constitution, which provides that states, “without the Consent of Congress,” may “engage in War” if they have been “actually invaded.”
In addition to enacting S.B.4, Texas has taken other steps to wage this war, including placing floating barriers in the Rio Grande and stringing razor wire to block invaders, and people who fund the cartels, from entering the state.
